What is the Subdivision and Development Appeal Board (SDAB)?

The SDAB is a quasi-judicial board established under the Municipal Government Act of the Province of Alberta. It is a tribunal, consisting of two aldermen and eight citizen members appointed annually by City Council. The Board hears appeals with respect to decisions of the Approving Authority and Development Authority and renders decisions based on relevant planning matters. Citizen members are appointed for two-year terms, and may serve a maximum of three terms.

Citizen board members must be citizens and electors of the city of Calgary and bring a wide range of experience to the Board including building and development, planning and law. Citizen members cannot be employees of The City of Calgary or members of the Calgary Planning Commission.

The Subdivision and Development Appeal Board is a quasi-judicial board and therefore, speaks only through its written decisions. Individuals may not directly contact any board member with respect to any appeal or potential appeal because this may disqualify them from participating in the hearing. The board members do not discuss appeal cases with the Approving or Development Authority prior to the hearing. In addition, individuals must not contact board members regarding the outcome of an appeal.

If persons appearing before the Board object to a board member sitting on a hearing, on the basis of bias, they should state their objection, and reasons for the objection, at the start of their presentation. The board member will then respond to the objection. The Chairman will consider the objection and the response of the board member and will determine if the member should stand down from the hearing.

Where and When does the Board Meet?

The SDAB holds public hearings, usually every second Thursday afternoon, commencing at 1:00 p.m. in the Engineering Traditions Committee Room, Lower Level, City Hall. The Board meets until all items on the agenda for that day have been dealt with, or until 9:00 p.m. Agenda items not dealt with are adjourned to the next scheduled hearing.
