Appeal Criteria
What Can Be Appealed?
- A decision of the Approving Authority concerning a subdivision
application.
- A decision of the Development Authority concerning a development
permit application.
- An enforcement order issued by the Development Authority.
- A decision of the Approving Authority concerning a subdivision
application:
- - The applicant.
- A government department, if the application was referred to
that department.
- A school authority, if the application involves a municipal
or school reserve.
- A decision of the Development Authority concerning a development
permit application:
- - The owner of the property.
- The applicant of the development permit.
- Anyone *affected by the decision.
- An enforcement order of the Development Authority:
- - The individual who was served the order.

- *The term "affected person" is not defined by the
Municipal Government Act. In general terms, an "affected
person" is someone who owns the property which is the subject
of the appeal, someone who may be materially affected by the
development, or someone who feels the enjoyment, use and value
of their property may be affected by the development.
