In accordance with the Municipal Government Act, an appeal to the SDAB must be received on or before the final date for appeal. Any appeal received after the deadline will not be considered by the SDAB. The deadline for filing varies depending on the type of appeal and who is filing the appeal. See below for specific information: Subdivision AppealsRefusal of a Subdivision ApplicationAn appeal may be filed by the Applicant of the subdivision application within 19 calendar days from the date the decision is mailed (14 days plus 5 days for mailing/deemed receipt). An affected person cannot file an appeal. Conditions of Approval of a Subdivision ApplicationAn appeal may be filed by the Applicant of the subdivision application within 19 calendar days from the date the decision is mailed (14 days plus 5 days for mailing/deemed receipt). An affected person cannot file an appeal. Development AppealsApproval of a Development PermitAn appeal may be filed by the Applicant of a development permit approval within 14 calendar days from the date the applicant was notified of the decision. An appeal may be filed by the Affected Person of a development permit approval within 14 calendar days from the date of the advertisement of the approval in the local papers. Refusal of a Development PermitAn appeal may be filed by the Applicant of a development permit refusal within 14 calendar days from the date the decision was picked up, delivered, faxed or received via registered mail. An affected person cannot file an appeal against a refusal. Enforcement OrderThe owner of the land, the person in possession of the land or building, the person responsible for the contravention or any person considered affected by an Order may file an appeal.
