If your vehicle is damaged by a commerical vehicle

If your vehicle is damaged by debris on the roadway, it is considered a road hazard and may be covered by your insurance. For these inquiries, contact the Insurance Bureau of Canada at 1-800-377-6378 or your own insurance company.

If your vehicle is damaged by material you witnessed falling off a commercial vehicle, contact the company directly and report the incident to the police.

  • You will need to provide the date, time and location of the incident; the commercial vehicle's identification, licence plate number and/or unit number; as well as a police statement and estimate of damage.
  • For charges to be laid, you must be willing to testify in court and have your vehicle's damage available to be photographed. You will be called to court when and if there is a plea of not guilty and a trial date is set. This will be approximately six months from the date of the charge being laid.
  • The company may provide some assistance with the cost of the damages to your vehicle. If they do not, you may sue for damages by contacting the Provincial Court, Civil Division located at 603 - 6 Ave S.W., phone (403) 297-7217. There is a fee to file a claim and it may be several months before the case comes before the courts.
